The Contract

1.1. Blind Megastore LTD website offers you the customer to purchase products. You will only enter a legally binding contract when Blind Megastore LTD has received payment for products you wish to purchase. Our system will automatically contact you of acceptance of your order via email provided by you the customer. Blind Megastore does not allow orders to be placed for overseas, this includes Ireland and Channel Islands.

Price

2.1 The cost of your blinds ordered by you the customer will be shown when entering your size,in the blind summary, and on the order confirmation page of the Blind megastore website. All prices shown include all taxes applicable.

2.2 Additional delivery costs can be incurred but you will be notified at the checkout of this additional cost. Delivery costs are classed as free when the order value exceeds £200. The Blind Megastore website ensures you are notified on the page of any additional costs.

2.3 All costs incurred including any delivery fee will be debited from your debit or credit card as soon as we receive your order or as soon a possible. The same process applies to all order placed through Pay Pal. On occasions goods may be delivered in stages, this will not affect your delivery price.

2.4 We constantly monitor and track prices; this can therefore lead to us amending our prices at any time to make items cheaper or more expensive. We reserve the right to do fluctuate our prices.

Right for You to Cancel Your Contract

3.1 Good that have started in the manufacturing process cannot be cancelled or amended. When you place your order they are made to your exact requirement and specification and therefore cannot be re-used in the future. We cannot accept any changes to the orders once the goods have started the manufacturing process. If you wish to cancel your order or realise a mistake has been made you must contact Blind Megastore immediately either by telephone or email and we will attempt to make any adjustments needed. Most orders are processed with 30 minutes and the blinds enter the manufacturing process immediately.

3.2 Blind Megastore offers a FREE services for samples to make sure customers are happy with the products they are getting when they order their blinds. Images on the website are photo-shopped and they are our interpretation of what we think the colour best represents; we therefore cannot accept responsibility if clients order a products and then dis-like or disagree with the colour their blind arrives in.

3.3 Blinds which You the customer orders are made to the information that you provide us with. Before placing any orders it is important that you are happy with your sizes, colour, quality and product before ordering. We DO NOT accept any returns of goods for quality or colour being to your disliking. As stated in 3.2 we highly recommend you exercise our FREE SAMPLING SERVICE to ensure this is the right product for you.

3.4 If your order has gone over 30 working days you reserve the right to cancel your order with a full refund

Cancellation by BlindMegastore

Blind megastore reserves the right to cancel your order fo rthe following :

4.1 Delivery is required outside of the UK

4.2 Blind Megastore or its manufacturers have stock shortages and cannot fulfil your order

4.3 An incorrect price has been generated from the website due to a technical or typographical fault made by ourselves.

4.4 If a promo code generates an unauthorised discount than initially agreed

4.5. In the situation of us cancelling your order you will be notified by email or phone as the earliest point possible. Your funds will be sent back to you on our part immediately, this can however take up to 30  days depending on various factors such as banks and time of year.

4.6 If we decide to exercise the right to cancel an order we are not obligated to offer any compensation. 

Stock Shortages

5.1 Throughout the year products can become out of stock, as soon as we are notified by our suppliers that the goods have a delay we will inform you by email or telephone to discuss whether you are happy to wait, would like a refund or have a suitable replacement

Product Descriptions and Measurement

        i.           All content and images on the Blind megastore site  are shown for illustrative purposes only, these images are our interpretation of what we think the blinds and colours look like and we cannot accept responsibility if you order your blinds and do not believe these to be accurate.

       ii.           We offer a FREE SAMPLING service to ensure you the customer can ensure you get the correct product and colour for you.

      iii.           When ordering your blinds please be aware that like with all textiles goods come in batches and can therefore change in colour at any time. We strongly recommend that if you are trying to keep to the same colour throughout the house or room blinds are orders together and not separately over a period of time. We cannot guarantee that you will receive the same batch colour if orders are place separately

     iv.           We strongly recommend that you call or email prior to any orders to ensure you are getting the product that is right for you, we cannot accept any responsibility for batch difference.        v.           All blinds from Blind Megastore are made to measure and manufactured to your precise measurements that YOU the customer provides. It is extremely important that the measurements you provide are correct as we cannot accept returns for blinds for the reason that the measurements provided are incorrect.

     vi.           We strongly advise you read all guides on our website first and call and speak to an expert to ensure what you are ordering is correct.  enquiry line on 01253 798 512 or contact Us by e-mail on sales@blind-megastore.co.uk if You would like guidance on how to take the required measurements accurately.

    vii.           We strongly attempt to ensure that all goods purchased match with samples or description that have been dispatched, minor variations of pattern, colour, shade will occur. The sample you receive is an example of a very similar product that will arrive if ordered, if you aredis-satisfied with this you are not entitled to return the goods or be due any compensation for minor changes

  viii.            All blinds are made to your precise measurements. Within the blind industry the nature of made to measure blinds our factory and supplies work within a 10mm tolerance, you need to ensure this is accounted as failure to do so which leads to dissatisfaction will not entitle you to a refund

Delivering Your Goods

        i.           Blind megastore does not personally delivery goods to your address provided; goods are typically delivered with insured couriers.

       ii.           You will receive an estimated delivery date within 30 days of when your order is first placed. We cannot guarantee that this date is the date which the blind will be delivered as this is outsourced to a external companies out of our control

      iii.           Goods can take up to 30 WORKING DAYS to arrive at the address provided. As a company we aim to deliver goods within 10 working days but we cannot made any guarantees this can always happen

     iv.           Goods are only delivered week days between the hours of 7:30am – 8:00pm

       v.           All goods must be signed for damaged or unchecked, failure to do so may result in us not being able to replace a faulty blind

     vi.           Couriers will make attempts to deliver your goods up to three times, if three failed attempts are made you will incur a second delivery charge of £6.95

    vii.           If the estimated date provided is not suitable please contact us immediately so we can accommodate any changes. We need 72hrs notice prior to your estimated delivery date to ensure goods delivery date can be amended

  viii.           When goods are received ownership and risk to the goods passes to you the customer.

     ix.           Delivery times and delivery of goods can be subject to Bank Holidays, Christmas, and seasonal weather changes. We cannot beheld responsible for failed deliveries within such circumstances.

Defective Goods

        i.           Blind Megastore offers a 12 month statutory guarantee on all products on the website.

       ii.           If within this period you blind become faulty you are entitled to return them to us to receive a replacement or repair.Replacements / repairs are only shipped when goods have been redelivered back to Blind Megastore.  

      iii.           Before collection of goods we require a ful ldescription of the error and also photographic evidence sending to our email sales@blind-megastore.co.uk

     iv.           If goods returned to us are NOT defective or the goods have been modified by the customer, misused or subject to negligence you will be responsible for all courier costs and repairs that will needed to be carried out.

       v.           When you 12 month guarantee is over any defective blinds are subject to a charge dependant on individual circumstances.

Use of Cards

        i.           By placing an order you authorise Blinds Megastore at its discretion to carry out a credit reference or other enquiry upon Your financial status as Blinds Megastore thinks fit and You agree to provide such written authorisations which may be required for the purposes of such enquiry.In the absence of such authorisation We will be unable to process Your order.

Representations

       ii.           No statement, description, or recommendation contained in any catalogue, price list, advertisement, communication, the pages of this web-site or by any employee or agent of Blind Megastore shall be interpreted so as to enlarge, vary or override in any way any of these terms and conditions.

Events Beyond OurControl

      iii.           We shall have no liability to You for any failure to deliver Goods You have ordered or for any delay in doing so or for any change of the specified delivery date or for any damage or defect to Goods delivered that is caused by any event or circumstance beyond Our reasonable control including, without limitation, third party default, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood,fire, explosion or accident.

Invalidity

     iv.           If any part of these terms and conditions is unenforceable (including any provision in which We exclude our liability to You) the enforceability of any other part of these conditions will not be affected.

Privacy

You acknowledge and agree to be bound by the terms of Our privacy policy.

Third Party Rights

Except for Our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

Governing Law

This contract is subject to English law and the exclusive jurisdiction of the English courts. If you are unsure about any of these terms and conditions then do not hesitate to contact us.
